Information on data protection

The protection of your personal data in connection with utilization of the services provided by Erbe Elektromedizin GmbH ("Erbe") is an important concern for Erbe. Erbe processes your personal data within the scope of your use of the Erbe website ("website") in accordance with the GDPR. Among other things, you will find information on the type, scope and purpose of the processing of personal data ("data") by Erbe in connection with the use of the website in the following:

1. Processing of data on the Erbe website

a) Provision of the website as well as data transmission and logging for statistical purposes

Your Internet browser transmits data to Erbe's web server when accessing the website. This is technically necessary for accessibility of the website. The following data are collected: date and time of access, URL of the referring website, accessed file, amount of data sent, browser type and version, operating system as well as your IP address. ("Access data"). The access data are stored separately from other data that you enter when using Erbe's website. The access data are also evaluated for statistical purposes and subsequently deleted. This is based on Erbe's justified interest in the continuous optimization of the website. The access data will be deleted after evaluation, after 3 years at the latest.

Access data shall be processed on the basis of Article 6, Section 1, Sentence 1, Letter f of the GDPR.

b) Making contact and newsletter

In as far as you provide Erbe with personal data via e-mail, contact form, telephone or social media, the data you provide (e.g. your e-mail address, your name or your telephone number) will be stored by Erbe in order to answer your questions or to provide you with access to the services you have requested (e.g. to provide information via our newsletter). If your request is directed to another Erbe company, e.g. a subsidiary of Erbe, we will forward it to the respective Erbe company.

You are not legally or contractually obliged to provide data when contacting us. However, please note that Erbe cannot process your request if you do not provide any of the required information marked as such.

Your data will be stored until your request is completely processed and then deleted by Erbe. This does not apply to data which are required for accounting and bookkeeping purposes or which are subject to the legal retention obligations. The duration of the storage of this personal data is governed by § 257 of the German Commercial Code and § 147 of the Fiscal Code.

Whe contacting us, your details will be processed for dealing with the contact request and its handling on the basis of Article 6 Section 1 Sentence 1 Letter f of the GDPR. If the aim of establishing contact is to conclude a contract, the additional legal basis is Article 6 Section 1 Sentence 1 Letter b of the GDPR. In the case of your consent (e.g. to the mailing of our newsletter), processing will be based on Article 6 Section 1 Sentence 1 Letter a of the GDPR. You can revoke your consent to the mailing of our newsletter at any time, e.g. via the link contained in our newsletter, with effect for the future.

c) Registration for the download area and the ErbeFacts online news portal

As an Erbe employee and Erbe contractual partner, you can register for the download area as well as ErbeFacts, Erbe's online news portal, and thus access current sales information. The data you provide during registration (e.g. your name, your address, your e-mail address or your telephone number) will be stored by Erbe in order to provide you with current sales information. At the time of registration, your IP address and the date and time of registration are also recorded. These data will not be passed on to third parties.

You are neither legally nor contractually obliged to provide data within the scope of registration for the download area nor for ErbeFacts. However, please note that Erbe cannot provide you with current sales information if you do not provide any required information marked as such.

Your data will be stored for the duration of the existence of the user account created as a result of registration and will be deleted by Erbe upon termination of the user account. This does not apply to data which are required for accounting and bookkeeping purposes or which are subject to the legal retention obligations. The duration of the storage of this personal data is governed by § 257 of the German Commercial Code and § 147 of the Fiscal Code.

To the extent that registration is necessary for the execution of a contract to which you are a party or is necessary for the implementation of pre-contractual measures, the processing of your transmitted data will be conducted on the basis of Article 6 Section 1 Sentence 1 Letter b of the GDPR. If you register as an Erbe employee for the download area as well as ErbeFacts, the processing of your transmitted data is in the interest of Erbe to provide their employees with access to current information from Erbe, on the basis of Article 6 Section 1 Sentence 1 Letter f of the GDPR.

d) Use of the Matomo web analysis service

Erbe uses the Matomo open source web analysis service (formerly Piwik) on the website to analyze and regularly improve the use of Erbe's website. These statistics can help Erbe to improve its services and make them more interesting for you as a user.

Cookies are stored on your computer for this evaluation. Cookies are small text files that are stored on your computer when you visit the website. Cookies help Erbe to determine the frequency of use and the number of users of the website and to make Erbe's offers as convenient and efficient as possible for you. If individual pages of the website are called up, the following data is stored by Erbe: two bytes of the IP address of the system accessed by you; the accessed website; the website from which you accessed the called up website (so-called referrer); the sub-pages that you accessed from the called up website; the duration of your stay on the website; the frequency of accessing the website. Erbe stores the data collected in this way exclusively on Erbe's server in Germany. The data are not passed on to third parties. The data will be deleted as soon as Erbe no longer needs them for the purposes mentioned. This is the case after 3 years.

This website uses Matomo with the "IP Anonymization" extension. This does not save IP addresses completely, but masks two bytes of the IP address (e.g.: 194.147.xxx.xxx). In this way it is not possible to assign the shortened IP address to the calling computer. The IP address transmitted by your browser using Matomo will not be merged with other data collected by Erbe.

You can prevent the evaluation of data by Erbe through the use of Matomo by deleting existing cookies and preventing the storage of cookies. You can do this by changing the settings in your Internet browser by deactivating or restricting the transfer of cookies. You can delete already stored cookies at any time. However, if cookies are deactivated for the website, not all functions of the website may possibly be able to be used in full.

e) Google Maps

Erbe uses Google Maps for the website to display interactive maps and to create directions. Google Maps is a map service of Google Inc, 1600 Amphitheatre Parkway, Mountain View, California 94043, USA ("Google").

When you visit an Erbe website that contains Google Maps, your browser connects directly to Google's servers. The map content is transmitted by Google directly to your browser and integrated into the website. Google may process the following data from you, in particular:

1. date and time of your visit to the website,
2. the internet address or URL of the visited website,
3. the IP address,
4. the (start) address entered in route planning,
5. device-related information, such as the model of hardware you are using, the version of the operating system, unique device identifiers and information about the mobile network including your phone number,
6. details on how you used Google services, such as your search queries,
7. location-related information, such as possibly your actual location.

If you have a Google Account, this information can be linked to your Google Account. For more information on how to view, manage or delete information associated with your Google Account, please see Google's privacy policy at policies.google.com/privacy.

Erbe has no influence on the processing and use of the data by Google and can therefore assume no responsibility for this.

You can also set your browser to block all cookies, including cookies linked to Google services, or to display a message when a cookie is set by Google. However, in this case, however, the Google Maps map display may no longer function properly.

f) Google Fonts

Erbe uses so-called web fonts provided by Google to uniformly display fonts. When visiting the website, your browser loads the required web fonts into your browser cache to display texts and fonts correctly. These web fonts are integrated by calling up Google's servers. Google may possibly process your data in this instance. Erbe has no influence on the processing and use of the data by Google and can therefore assume no responsibility for this.

g) Use of the Vimeo-Plug-in

Erbe integrates videos on its website via Vimeo.com. This is a service provided by Vimeo Inc, 555 West 18th Street, New York, New York 10011, USA ("Vimeo").

When you access videos via Vimeo, a connection to Vimeo's servers is established. This may possibly allow a Vimeo server to know which Erbe website you have visited. If you are logged in as a member of Vimeo, Vimeo will assign this information to your personal user account. When using the plug-in, for example when clicking the start button of a video, this information is also assigned to your user account. You can prevent this assignment by logging out of your Vimeo account and deleting the corresponding Vimeo cookies before using our website.

Erbe does not receive information on the content of the data collected by Vimeo or third parties and has no influence on their use. By integrating videos, Vimeo can also receive information that your browser has called up the corresponding page of this website, even if you do not have a Vimeo user account or are not currently logged in to Vimeo.

h) Podigee Podcast Hosting

Erbe uses the Podigee podcast hosting service of the provider Podigee GmbH, Ritterstraße 2A, 10969 Berlin, Germany. The podcasts are uploaded by Podigee or transferred via Podigee.

The use is based on our legitimate interests, i.e. the interest in a secure and efficient provision, analysis and optimization of our podcast offer according to Art. 6 Sec. 1 lit. f. GDPR.

Podigee processes IP addresses and device information to enable podcast downloads/playbacks and to determine statistical data, for example, download numbers. These data are anonymized or pseudonymized before being stored in Podigee's database, insofar as they are not required for the provision of podcasts.

i) Social Media 

When you visit our websites, the social plug-ins are deactivated and no data is transmitted to these networks. If you want to use one of the networks, click on the respective social button to establish a direct connection to the server of this network. If you have a user account on the network and are logged in when you click on the social button, the network can associate your visit to our websites with your user account. If you want to avoid this, please log out of the network before clicking on the social button.

j) LinkedIn, LinkedIn Ads, LinkedIn Analystics and LinkedIn Marketing Solutions

Erbe uses the services of LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland ("LinkedIn"). Within the scope of these services, LinkedIn collects and stores user data in pseudonymous profiles to facilitate statistical analyses on the use of the website and success of ads as well as interest-based advertising on our websites and on LinkedIn and partner websites of LinkedIn. If you are a LinkedIn user, LinkedIn may also reconcile the data with your user account. LinkedIn uses cookies for collecting data (see section d). You can deactivate this as well as the resulting data collection on the following websites:

Usually, the deactivation is stored in a cookie. Therefore it has to be renewed if you delete cookies. The deactivation also has to be installed in every browser that you use.

k) Meta, facebook, Instagram

We integrated functions of the service Instagram on Erbe websites. These functions are offered by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland. If you are logged into your Instagram or facebook account, you can link the content of our pages to your Instagram profile by clicking the Instagram button. This allows Instagram to associate your visit to our sites with your account. We would like to point out that Erbe, as the provider of the pages, has no knowledge of the content of the transmitted data or its use by Instagram. 2. Your rights

a) You have the following rights vis-à-vis Erbe with regard to your personal data:

- according to Article 15 GDPR, you can request information about your stored personal data;

- according to Article 16 GDPR you can demand the correction of incorrect personal data;

- according to Article 17 GDPR you can demand the deletion of your data;

- according to Article 18 GDPR you can demand the restriction of the processing of your data;

- according to Article 20 GDPR, you can demand to receive your provided data in a structured, common and machine-readable format;

insofar as the corresponding legal requirements for the claims are given. The right to information according to Art. 15 GDPR and the right to deletion according to Art. 17 GDPR are subject to the limitations according to §§ 34 and 35 BDSG (Federal Data Protection Act).

b) Furthermore, you have the right to complain to a data protection supervisory authority about the processing of your data by Erbe (Article 77 GDPR).

c) If you have given Erbe your consent, you also have the right to revoke this consent to Erbe at any time with effect for the future.


3. Disclosure of personal data

Your data transmitted to Erbe via the website will be disclosed by Erbe to the following recipients or categories of recipients:

- service providers who support Erbe in making the offer available on this website. These service providers process data exclusively on behalf of and under our control and only for the purposes described in this data protection information.

- Those public or non-public entities to which Erbe is required to disclose personal data in order to fulfil a legal obligation.

If you have given your consent or if Erbe is otherwise legally authorized to do so, Erbe may, if applicable, pass on your personal data to subsidiaries of Erbe for the purposes described in this data protection information. If in this context your personal data is transferred to a so-called third country, Erbe will take measures to ensure an appropriate level of data protection by other means, in particular the use of standard data protection clauses in accordance with Art. 46 Section 2 Letter c) of the GDPR.

 

4. Right of revocation

You have the right to object at any time to the processing of data concerning you by Erbe and collected under Article 6 Section1 Letters e or f GDPR for reasons arising from your particular situation, this also applies to profiling based on these provisions. Following an objection, Erbe will no longer process the data concerning you, unless Erbe can prove compelling grounds for processing that outweigh your interests, rights and freedoms, or that processing serves to assert, exercise or defend legal claims. If the data concerning you are processed for direct marketing purposes, you have the right to object at any time to the processing of the data concerning you for the purpose of such advertising, this also applies to profiling in so far as it is related to such direct marketing. If you object to the processing for direct marketing purposes, the data concerning you will no longer be processed for these purposes. You have the possibility to exercise your right of objection in connection with the use of services of the information company by means of automated procedures where technical specifications are used, notwithstanding Directive 2002/58/EC.
